TERMS OF SERVICE

These Terms of Service ("Terms") govern all products, services, and transactions offered by Fourth Co. (operating as Fourth Co., Blake, Sending Sounds LLC, and Booth Bunny Records), collectively referred to as "we," "us," or "our." By purchasing any product or service, you ("Customer," "Student," or "Client") agree to these Terms in full.
If you do not agree to these Terms, do not complete your purchase.
1. WHO WE ARE
These Terms apply to all products and services sold under the following brands:
Fourth Co. — Artist brand, music releases, DJ services, and digital products
Blake — Person, owner, and operator of all things Fourth Co., Sending Sounds LLC, and Booth Bunny Records
Sending Sounds LLC — Music mentorship program, educational content, and coaching services
Booth Bunny Records — Record label, sample packs, and licensing services

2. PRODUCTS AND SERVICES COVERED
These Terms apply to all of the following:
The Sending Sounds 90-Day Mentorship Program
Mixing and mastering services
Sample packs and stem packs
Music releases and licensing
Ebooks, guides, checklists, and digital downloads
DJ and live performance services
Any other products or services offered by Fourth Co., Sending Sounds LLC, or Booth Bunny Records
3. PAYMENTS AND PRICING
All prices are listed in USD. Payment is processed securely through Stripe. By completing a purchase, you authorize the full charge as displayed at checkout.
Payment Plans: Where a payment plan is offered, the first payment secures your spot or access. Subsequent payments are due on the dates agreed upon at the time of purchase. Failure to complete a payment plan results in suspension of access until the outstanding balance is paid.
Currency: All transactions are in US dollars. International customers are responsible for any currency conversion fees charged by their bank or card provider.
Taxes: You are responsible for any applicable taxes, duties, or levies required by your local jurisdiction.
4. REFUND POLICY
Digital Products (Sample Packs, Ebooks, Guides, Checklists, Presets): All digital product sales are final. No refunds are issued once a digital file has been delivered or made accessible. Please review all product descriptions carefully before purchasing.
Mixing and Mastering Services: Payment is due before work begins. Refunds are not available once work has commenced. If you are unsatisfied with the final delivery, one round of revisions is included at no additional cost. Additional revision rounds are available at an agreed-upon rate. Resending stems and additional audio files not agreed upon in the initial files will incur additional costs.
Sending Sounds Mentorship Program: Refunds are not available after the kickoff call has been completed. If you have paid and wish to cancel before your kickoff call, a full refund will be issued within 7 business days. After the kickoff call, no refunds are issued under any circumstances. See Section 6 for the continuation guarantee.
DJ and Live Performance Services: Deposit payments are non-refundable. If an event is cancelled by the client within 14 days of the event date, the full agreed fee is owed. Cancellations made more than 14 days in advance forfeit the deposit only.
5. MIXING AND MASTERING SERVICES
Turnaround Time: Standard turnaround is 5-7 business days from receipt of all required files. Rush requests may be accommodated at an additional fee.
File Requirements: You are responsible for delivering properly organized, labeled project files or stems as directed. Incomplete or improperly formatted submissions may delay turnaround.
Ownership: You retain full ownership of your master recordings. By submitting your music, you grant us a limited, non-exclusive license to access and process your files solely for the purpose of completing the requested service.
Confidentiality: We will not share, distribute, or use your unreleased music for any purpose other than the service requested without your explicit written consent.
Revisions: Three rounds of revisions are included with every mix and master. Additional revisions are billed at an agreed-upon hourly or per-revision rate.
6. SENDING SOUNDS MENTORSHIP PROGRAM
Enrollment: Enrollment is confirmed upon receipt of full payment or the first installment of a payment plan. Spots are offered on a first-come, first-served basis.
Student Commitment: To receive the full benefit of the program and qualify for the continuation guarantee, students must:
Attend all scheduled calls or provide 24-hour advance notice of cancellation
Submit work for feedback as assigned
Maintain active communication via Discord, text, or voice note
Complete weekly assignments to the best of their ability
The Continuation Guarantee: If a student fulfills the commitment outlined above and does not achieve the three program outcomes (3 professional songs, an authentic artist brand, and a fan conversion system) within 90 days, we will continue mentoring at no additional charge until those outcomes are achieved.
The guarantee is void if the student misses 2 or more consecutive weeks without communication, fails to complete assigned work without reasonable explanation, or requests a refund after the kickoff call.
Results Disclaimer: Individual results vary. Success in the music industry depends on factors including but not limited to student effort, consistency, talent, and market conditions. We make no guarantee of specific commercial outcomes including streams, followers, label signings, or booking fees.
Community Access: Discord access is granted upon enrollment and continues for the lifetime of the program. Alumni access to the Discord community is granted upon successful completion of the 90-day program. Membership and access removal from the Discord community is at the discretion of the owner and moderators for any reason(s).
7. SAMPLE PACKS AND STEM PACKS
This section governs the purchase and use of all sample packs and stem packs sold under Fourth Co. and Booth Bunny Records.
License Granted Upon Purchase: When you purchase a sample pack, you receive a non-exclusive, non-transferable license to use the included sounds in your own original music productions for personal, non-commercial purposes.
Official Commercial Release: Use of these samples in any music intended for commercial release (including distribution on Spotify, Apple Music, SoundCloud, Beatport, or any other platform, free or paid) requires explicit written permission from Fourth Co. / Booth Bunny Records prior to release. To request permission, email support@fourthco.co with your track, intended release platform, and label (if applicable). Permission requests are reviewed on a case-by-case basis and are not automatically granted.
Remix Releases: If you purchase stems or samples for the purpose of creating a remix for official release, the same permission process applies. Unofficial remixes for personal use or non-monetized SoundCloud uploads do not require additional permission beyond purchase, provided no commercial activity is associated with the upload.
Prohibited Uses: You may NOT:
Resell, redistribute, or sublicense the samples or stems as standalone audio files, sample packs, or loop packs
Use the samples in NFTs, AI training datasets, or generative AI tools without explicit written permission
Claim ownership of the original samples or stems
Use the samples in music that promotes hate speech, violence, or illegal activity
Credit: While not always required, crediting Fourth Co. or Booth Bunny Records in your release metadata or liner notes is appreciated and encouraged. Permission requests for credits are reviewed on a case-by-case basis and are not automatically granted.
8. MUSIC RELEASES AND LICENSING
All music released under Fourth Co. and Booth Bunny Records is protected by copyright. Unauthorized reproduction, distribution, sampling, or synchronization of our music releases is prohibited without a licensing agreement.

9. DJ AND LIVE PERFORMANCE SERVICES
Booking: All bookings require a signed agreement and deposit to be confirmed. Verbal agreements do not constitute a confirmed booking.
Equipment: Unless otherwise agreed in writing, Fourth Co. provides all DJ equipment required for the performance. Venue must provide an adequate power supply and performance space as specified in the booking agreement.
Performance Rights: We are not responsible for obtaining venue performance licenses (ASCAP, BMI, SESAC). That responsibility lies with the venue or event organizer.
10. INTELLECTUAL PROPERTY
All content created by Fourth Co., Sending Sounds LLC, and Booth Bunny Records — including but not limited to tutorial videos, educational documents, templates, frameworks, Ableton templates, preset packs, and written materials — is protected by copyright and remains our exclusive intellectual property.
Students and clients may use these materials for their own personal music production and artist development. You may NOT:
Reproduce, resell, or redistribute any educational content or templates
Share Vault content, Ableton templates, or presets with non-enrolled individuals
Use our frameworks or systems as the basis for your own competing educational product without written permission
Violation of any of the above constitutes copyright infringement and a material breach of these Terms. We reserve the right to pursue all available civil and criminal legal remedies against any individual or entity found to be in violation, including but not limited to claims for damages, injunctive relief, and recovery of legal fees. Violations will be taken seriously and acted upon without warning.
11. PRIVACY
We collect only the information necessary to deliver our products and services (name, email, phone number, address, and payment details). We do not sell your personal information to third parties. Payment data is processed and stored securely by Stripe and is never held directly by us.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Fourth Co., Sending Sounds LLC, and Booth Bunny Records are not liable for any indirect, incidental, or consequential damages arising from the use of our products or services. Our total liability in any dispute is limited to the amount paid for the specific product or service in question.
13. DISPUTE RESOLUTION
We will always attempt to resolve disputes directly and in good faith. If you have a concern, contact support@fourthco.co before initiating any formal dispute process. Most issues can be resolved within 10 business days.
If a resolution cannot be reached, disputes will be governed by the laws of the State of Illinois, and both parties agree to submit to the jurisdiction of the courts located in Cook County, Illinois.
14. MODIFICATIONS TO THESE TERMS
We reserve the right to update these Terms at any time. Updated Terms will be posted with a new effective date. Continued use of our products or services after an update constitutes acceptance of the revised Terms.
